Petition under Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner (mother in law) for quashing of Complaint dated 06.11.2023 lodged at P.S. Dwarka South by respondent No. 2 (daughter in law).

Learned APP for the State appears on advance notice and accepts notice.

Learned counsel for petitioner submits that petitioner is a retired CJM (senior citizen) and is being harassed and tortured by her daughter in law (respondent No. 2). parties. A complaint, which is subject matter of present proceedings, is stated to have been further filed by respondent No. 2. 4.

Learned APP for the State, on instructions from IO/SI Suman, P.S. Dwarka South, informs that matter is still at the stage of inquiry in CAW Cell, Dwarka and FIR is yet to be registered.

Considering the totality of facts and circumstances, since the complaint is still under inquiry with CAW Cell, petition preferred by the petitioner for quashing of complaint appears to be premature at this stage. In case, on inquiry, CAW Cell, Dwarka intends to recommend the case for registration of FIR, a notice of seven days shall be given to the petitioner by IO/SHO, P.S. concerned before taking any coercive action against the petitioner. Petition is accordingly disposed of without prejudice to the rights and contentions of the petitioner and with liberty to prefer appropriate proceedings, in the eventuality of registration of FIR. Pending applications, if any, also stand disposed of.
