The present petition under Sections 397/401 read with Section 482 of the Cr.P.C. seeks following prayers:- "It is, therefore, prayed that this Hon‟ble court may graciously be pleased to:
I. Allow the present petition and may call trial court record from the Ld. MM Court i.e. from the Court of Ms. Shazadi Halima Sadiya, KKD Court, PS-New Ashok Nagar.
II. Allow the Revision Petition and set aside the order dated 07.02.2024 passed by the Ld. Metropolitan Magistrate of the Hon‟ble Trial Court whereby complaint under section 138 read with section 141 of negotiable instrument act 1881 has been dismissed on grounds of non-prosecution and non-appearance.
III. Any other order or direction which may be deemed fit and proper in the facts and circumstances of the case and in the interest of justice." 2.
Learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law before the Court of competent jurisdiction.
