Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (earlier under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No. 0188/2022 under Section 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Jagat Puri, Shahdara, Delhi The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
and all the consequential proceedings emanating therefrom, in view of the Settlement/No Objection Certificate/Affidavit inter se the parties. 4.

On advance Notice, learned APP has appeared and accepts the Notice on behalf of the State.

Brief facts of the case are that the Petitioner No. 1, Smt. Nirmala Gaur is the mother-in-law and the Petitioner No. 2, namely, Mr. Arvind Kumar Gaur is the brother-in-law of the Respondent No. 2. The marriage between Mr. Sudhir Kumar (son of Petitioner No. 1) and the Respondent No. 2 was solemnized, according to the Hindu Rituals and Customs at Delhi. They blessed with two kids, namely, Suryansh and Master Rudraansh in 2014 and 2019 respectively.

On the Complaint of the Respondent No.2/Complainant, FIR No.0188/2022 under Section 498A/406/34 IPC, got registered at Police Station Jagat Puri, Shahdara, Delhi. In 2022, the Respondent No. 2 filed a Petition under Section 125 Cr.P.C. for maintenance against her husband, Mr. Sudhir Kumar Gaur, before the learned Court of Shahdara, KKD, Delhi. 8.
It is submitted that the said FIR was a consequence of the matrimonial disputes between the Complainant and the Petitioners. It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement/No Objection Certificate dated 09.05.2025, filed by the Respondent No. 2. It is settled between the parties that they shall resolve their disputes amicably and to end all civil or criminal litigations against each other and since then the Respondent No. 2 is living happily with her husband along with their kids and also withdrawn both the said cases.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the said FIR is quashed. 10.
Both the parties have entered into the Settlement/No Objection Certificate dated 09.05.2025 voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 11.
Considering that the parties have settled the matter, the FIR No. No.0188/2022 under Section 498A/406/34 IPC, registered at Police Station Jagat Puri, Shahdara, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
