% 10.04.2018 By this petition the petitioner seeks parole on the ground that he has to file Special Leave Petition.
Learned Additional Standing Counsel for the State submits that special leave petition on behalf of the petitioner being SLP No. 1214/2018 has already been filed and notice in the same has been issued by the Hon'ble Supreme Court. The next date before the Hon'ble Supreme Court is 27th April, 2018.
Be that as it may, the petitioner has been in continuous custody since the date of his arrest i.e. from 1st October, 2012 except for an interim bail for a period of 10 days with effect from 11th May, 2016 by this Court when he surrendered in time and did not misuse the concession. Considering the fact that the petitioner has been in continuous incarceration for nearly more than 5 years, this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court/ CMM concerned. During the period of parole the petitioner will reside with his parents only at village Jatola, Distt. Palwal Haryana and will not approach his wife or the two daughters at New Heera Park, Najafgarh, New Delhi who are living in a rented accommodation. The petitioner will also report to SHO Palwal during the period of release on every Monday at 4.00 PM. Petition is disposed of.
Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
