The petitioner, who is a Junior Judicial Assistant in the respondentestablishment, has filed this writ petition under Article 226 of the Constitution, seeking 1st financial upgradation under the Modified Assured Career Progression Scheme with effect from 29.11.2020. 2.

the respondent, is present in Court, and at the request of the Court, accepts notice.

It appears from the content of the writ petition that the petitioner has not yet made a representation to the respondent, but has addressed a legal notice dated 01.03.2025.

I am of the view that, at the first instance, it is appropriate to give the respondent an opportunity to consider the petitioner's request and take an appropriate administrative decision.

Mr. Pankaj Jain, learned counsel for the petitioner, is also agreeable to this course of action.

The writ petition is, therefore, disposed of with a direction that the writ petition will be treated as a representation before the respondent. The representation be disposed of by a speaking order within a period of two months from today.
