O R D E R

The present petition has been filed by the petitioner seeking that the respondents be directed to refund the amount of stamp paid by the petitioner under the e-Stamp Certificate No. IN-DL04172672734343W dated 17.12.2024 of Rs.13,65,000/-.

The said e-stamp certificate was purchased by the petitioner for registration of a sale deed pertaining to property bearing no. 14A/29, WEA, Karol Bagh, New Delhi-110005; however, the sale deed was never executed since the agreement to sell was repudiated by the vendors therein in the last week of March, 2025.

Accordingly, since the e-stamp certificate was of no immediate use to the petitioner due to the repudiation of the abovementioned agreement, the petitioner filed an application in the office of the respondent no. 2 on 07.04.2025, for a refund of the amount of Rs. 13,65,000/- paid towards the purchase of the said e-stamp certificate.

It is submitted that the petitioner has been following up with the respondents, for processing their application for the refund of the amount of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Rs. 13,65,000/- paid towards the purchase of the said e-stamp certificate, in terms of Section 54 of the Indian Stamp Act, 1899. However, the same has not been considered till date.

During the course of proceedings attention of this Court has been brought to the order dated 02.05.2025 passed by this Court in W.P.(C) 1756/2025, in a similarly situated matter, wherein this Court has disposed of the said petition by passing the following directions - "8. There appears no impediment to the respondent no. 2 in considering the aforesaid application of the petitioners in terms of Section 54 of the Indian Stamp Act, 1899.

9. Let the said application be considered by the respondent no. 2, and a decision thereon be taken expeditiously, and in any event within a period of four weeks from today.

10. In case the application of the petitioners is rejected, a reasoned order shall be passed by the respondent no. 2."

In the circumstances, this Court finds it apposite to dispose of the present writ petition in the same terms. Accordingly, respondent no. 2 is directed to decide the application of the petitioner dated 07.04.2025 within a period of four weeks from today. In the event of the respondent no. 2 being inclined to reject the said application, a reasoned and speaking order shall be passed and provided to the petitioner, in accordance with law. 7.
