The present petition seeks quashing of FIR No. 709/2022, registered at P.S. Mehrauli under Sections 498A/406/34 of the Indian Penal Code, 1860. This request is made pursuant to a Memorandum of Understanding dated 10th July, 20231, relied upon by the Petitioners. As per the MoU, Petitioner No. 1 and Respondent No. 2 are living happily under one roof and according to the Petitioners, Respondent No. 2 does to wish to continue with the proceedings against the Petitioners.

Respondent No. 2, who appears in person, disputes the settlement and states that she does not wish to withdraw the FIR. She submits that Petitioner No. 1, in a state of intoxication, abuses and assaults her. He also 1 "MoU"

does not provide her medical care or fulfil the familial duties as her husband. In such circumstances, Respondent No. 2 states that she does not consent to the quashing of FIR.

In light of the foregoing statement of Respondent No. 2, the present petition is dismissed.

The Petitioner shall be free to pursue other remedies, as are available under law. In case there is indeed a genuine settlement between the parties at a later point of time, they shall be free to approach the Court, in accordance with law.
