% 12.02.2018 Learned counsel for the petitioner submits that petitioner was appointed as Head of Human Resource Department of "PNM Services Pvt. Ltd." on 9th June, 2013 on a monthly salary of `30,000/- . Without the knowledge of petitioner, she was inducted as Director of PNM Services Pvt. Ltd on 20th June, 2013 on the basis of her digital signatures.
On coming to know this fact, the petitioner resigned as Director on 20th June, 2014. Copy of DIR Form is annexed as P/4.
FIR was registered on 19th December, 2015.
Petitioner is not named in the FIR.
Learned APP submits that petitioner holds 25% of shares in PNM Services Pvt. Ltd while Mr. Nitin Kumar, Director, holds majority of its shares, who has since been arrested.
Keeping in mind the totality of circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. It is further ordered that petitioner shall appear before the Investigating Officer/Arresting Officer/SHO concerned as and when so directed. Bail application is disposed of in the above terms.
