This is an Application under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 for disposal of the Suit in terms of the Settlement arrived at between the Plaintiff and Defendant No. 1 during the pendency of the present Suit. The Plaintiff and Defendant No. 1 have mutually resolved all their ongoing and pending disputes between them as per the Settlement Agreement dated 07.10.2025 ("Settlement Agreement"), which is annexed to this Application.

In view of the above, the Plaintiff and Defendant No. 1 are directed to be bound by the terms of the Settlement Agreement. 3.
In view of the Settlement Agreement, the Plaintiff does not press any relief against Defendant Nos. 2 and 3. Accordingly, the Suit is decreed in terms of the Settlement Agreement. Let the Decree Sheet be drawn up accordingly.

In view of the fact that the matter has been settled at an early stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the Plaintiff, in terms of Section 16 of the Court Fees Act, 1870. 5.
It is however, made clear that in case any dispute arises between the Parties and in the event, either Party approaches this Court for enforcement of the Settlement Agreement/ Decree, the said Party or Parties will become liable to pay the entire Court Fees thereon.

In view of the order passed in I.A. 25239/2025, the present Suit is disposed of. All pending Applications also stand disposed of. 7.
