The issue arising in the present writ petition was crystallised in the order dated 03.11.2020, which reads as under: "....

3. The limited grievance of the petitioners in the present petition is that by the Impugned letter dated 29.12.2018, while repudiating the claim of the petitioners under Section 45 of the Insurance Act, 1938, the respondent advised the petitioners to file a representation with the Zonal Manager in case the petitioners were dissatisfied with the said rejection. The petitioners availed of this remedy and filed a representation dated 02.05.2019, however, no decision on the same has been received by the petitioners till date.

4. Let counter affidavits be filed within a period of three weeks of receipt of notice. Rejoinder, if any, be filed within two weeks thereafter.

Learned counsel for the petitioner states that the decision on representation dated 02.05.2019 is still awaited, although only a partial amount has been released post passing of the aforesaid order. 3.

Without prejudice to the rights of the either parties and taking note of the aforesaid order, the petition is disposed of with a direction that the respondent would consider the representation in a time-bound manner and not later than three months from today by giving a speaking order. 4.
