W.P.(CRL) 367/2018 Petitioners are seeking quashing of the present FIR i.e. the FIR No.0092/2017 registered under Sections 498A/406 of the IPC at police station Palam Village on the complaint of respondent no.2. Respondent no.2 is present in person. Her presence has been identified by the Investigating Officer. The petitioner no.1 and respondent no.2 had been married according to the Hindu rites in the year 2015. Their marriage did not work out and they agreed to go in
for divorce by mutual consent. The divorce was granted by the decree dated 20.12.2017. No child was born out from the wedlock. In terms of the settlement arrived inter se the parties a sum of ₹4,50,000/- has been agreed to be paid by petitioner no.1 to respondent no.2 of which ₹2,25,000/- already stands paid and ₹2,25,000/- has been paid to respondent no.2 in the Court today. This is fit case where the prayer made in the application should be allowed. Accordingly, FIR No.0092/2017 registered under Sections 498A/406 of the IPC at police station Palam Village and all the proceedings emanating therefrom stand quashed. Petition disposed of.
