The petitioner stood trial and was convicted for offences punishable under Sections 395/186/332/353 IPC by order dated 29.11.2014 of the court of sessions in case FIR No.142/2012 of Police Station Maurya Enclave, New Delhi. He challenged the said conviction and order on sentence but his Criminal Appeal No.358/2015 was dismissed by this court on 22.08.2016. He requested for release on parole on 27.10.2016, but his request has been declined by the State by communication dated 02.01.2017 referring, inter alia, to the fact that he is involved in three other serious crimes. While conceding that the trials of the said three other cases are still pending, it is pointed out in two of those cases, they being FIR No.212/2012 under Sections 365/395/397 IPC of Police Station Mangol Puri and FIR No.187/2012, under Sections 302/396/398 IPC of Police Station Badli, the W.P.(CRL) 497/2017

petitioner is on bail. But, it is conceded that in the third case, the petitioner is facing trial as an under trial prisoner, the same arising out of FIR No.377/2009 under Sections 302/394/120-B IPC of Police Station Kotwali, Ghaziabad, U.P.

Having regard to the gravity of the offences involved in the said third case, this court agrees with the reasons for denial of release on parole as set out by the Deputy Secretary (Home). The petitioner may avail of services of Legal Aid Authority for filing the Special Leave Petition in the Supreme Court of India.

The petition is dismissed.
