Learned counsel for the appellant concedes that the present appeal may not be maintainable in view of the judgment passed by the Supreme Court in Shyam Sel And Power Limited & Anr. v. Shyam Steel Industries Limited, (2023) 1 SCC 634. In view thereof, he prays to withdraw the present appeal.

Further, learned counsel for the respondent has no objection to the same.

Accordingly, the appeal is permitted to be withdrawn. It is left open to the plaintiff/appellant to move appropriate application before the learned Single Judge for expeditious disposal of the suit.
