CONT.CAS(C) 766/2025 & CONT.CAS(C) 768/2025 1.

These petitions allege wilful disobedience of order dated 26 th April 2023 passed in the case- Mt. No.219/2022 and order dated 15th January 2025 passed in the case- Mt. No. 232/2023. The respective orders had been passed directing maintenance of Rs.1 lakh to be paid by respondent-husband to wife and Rs.80,000/- by respondent-father to the son. 2.

Both the wife and the husband challenged these orders in criminal revision petitions, which were dismissed. Thereafter, SLPs were filed by both of them. While the SLP filed by wife has been dismissed, notice has been issued in SLP filed by the husband on 24th March 2025, but no stay has been granted.

Counsel for husband states that matter is listed before the Supreme Court on 19th May 2025.

He further states that out of Rs.33 lakhs, Rs.30 lakhs have been paid to wife and as regards the son, execution has been filed wherein 4 months' time has been granted to him to pay.

Counsel for petitioner, however, states that arrears are, in fact, more than this.

Notwithstanding, there is no reason as to why arrears should remain unpaid as far as maintenance payments are concerned. 7.

It is accordingly directed and accepted by the respondent that he will pay arrears of Rs.3 lakhs within next two months, 50% of which shall be paid on or before 15th June 2025, and balance 50% shall be paid on or before 15th July 2025.

It is accordingly directed that respondent will pay 50% of this within next 2 months, and balance 50% shall be paid in 2 months thereafter. 10.

Notwithstanding that these directions pertain to payment of arrears, monthly maintenance shall continue to be paid by the respondent. 11.

Counsel for the respondent states that cross-examination of petitioner is being delayed due to adjournments sought by the petitioner. This is not appreciated. Proceedings before the Trial Court shall continue expeditiously with cooperation of all the parties.

With these directions, both these petitions stand disposed of 13.

Pending application, if any, stands disposed of as infructuous. 14.
