Petition bearing No. CRL.M.C. 3366/2025 and Petition bearing No. CRL.M.C. 3758/2025 under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.‟) (read with Section 482 of the Code of Criminal Procedure, 1973) (hereinafter referred to as 'Cr.PC'), have been filed on behalf of the Petitioner, namely Harish Singh in CRL.M.C. 3366/2025 and Petitioner, namely, Pawan Jindal in CRL.M.C. 3758/2025 for quashing of cross-FIR Nos.928/2020 and 926/2020 under Section 323/341/506 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Bindapur and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 23.12.2024.

On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

It is submitted that essentially, Mr. Pawan Jindal, Petitioner in FIR No.926/2020 has stated that he was living in the ground floor while Ms. Sudha Singh, wife of Mr. Harish Singh in FIR No.928/2020 was living on the first floor and they had some dispute about the construction being carried out by the Complainant lady in the month of February, 2020 on Plot No. 220, Colony R Block, Uttam Nagar, New Delhi-110059 and the cross-FIRs got registered.

On the Complaint of the Respondent No.2 in both the Petitions, crossFIR Nos.928/2020 and 926/2020 under Section 323/341/506 of IPC, got registered at Police Station Bindapur.

Now, the Petitioner, Pawan Jindal had vacated ground floor of the house in 2021 and with the intervention of the family members and the neighbours, the parties have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 23.12.2024. In the Settlement, it was inter alia settled between the parties that the Respondent No. 2 in both the Petitions shall give „No Objection' for the purpose of quashing the cross-FIRs. It was also settled that they shall not be left with any grievance or claim (either present or future) or cause of action arising out of dispute, which arose between them. 7.

Today, the Respondent No. 2/Complainant in both the Petitions, are present in the Court and identified by the Investigating Officer, state that they have no objection if the cross-FIRs are quashed. 8.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering that it was a neighbourhood dispute and that they have settled the matter, the cross-FIR Nos. 928/2020 and 926/2020 under Section 323/341/506 of IPC, registered at Police Station Bindapur and all the consequential proceedings emanating are quashed. 10.

The Petitions are disposed of accordingly.
