CRL. M.A. 6257/2017 in W.P.(CRL) 324/2017 The petitioner seeks extension of parole which was granted to him by order dated 16.03.2017.

On that occasion, the petitioner had sought parole on the ground that he was required to help his father in constructing his residential house. The petitioner was granted parole of four weeks from the date of his release subject to certain conditions. It is stated at the bar that the petitioner was released on parole on 20.03.2017. The period of parole expires today i.e. on 18.04.2017.

In the present application, the petitioner seeks extension on the ground that he is required to appear in two papers of English and Public Administration of B.A. First Year in which he could not pass earlier. First of such papers in English is to be held on 18.04.2017 i.e. today and the other paper of Public Administration is on 20.04.2017. Since the application has been listed today only, the Additional Standing Counsel could not get the facts stated in the application verified.

Be that as it may, considering the fact that the petitioner has been pursuing his studies from jail and is desirous of completing his graduation, this court is inclined to and extends the parole for a further period of two weeks.

However, Ms. Richa Kapoor, ASC would get such statement and the dates of the examination verified and in case the statements are found to be incorrect, the matter would be reported to this court whereupon necessary action would be taken against the petitioner. Needless to state that on the expiry of two weeks, to be counted from today, the petitioner shall surrender forthwith before the Superintendent of the concerned jail. During the parole period the petitioner would be required to report to the SHO on every alternate day at 10:00 a.m. The petitioner shall be allowed to remain on parole on the same bond which was executed earlier.

The learned counsel for the petitioner is directed to furnish the address of the petitioner today to Ms. Richa Kapoor, Additional Standing Counsel who shall forthwith communicate the same to the SHO of the concerned Police Station.

The application is allowed.
