Petitioner impugns order dated 23.04.2019, whereby, application filed by the petitioner under Order VII Rule 11 has been dismissed with costs of Rs.5,000/-.

After some arguments, learned counsel for the petitioner submits that in case the cost is waived, he shall not press this petition. 3.

Keeping in view of the facts and circumstances of the case, the costs imposed by impugned order dated 23.04.2019 of Rs.5,000/- is waived. 4.

Learned Counsel for the petitioner seeks leave to withdraw the petition.

Petition is dismissed as withdrawn with the aforesaid directions. 6.
