It is pertinent to mention that the present writ petition has been filed seeking a direction to the Respondent No.1 to implement the award dated 15th February, 2013 and hand over possession of Flat No.36 of Karuna Vihar, CGHS Ltd. to the Petitioner.

Learned counsel for the Respondent No.1 states that the Respondent No.1 has already written a letter dated 18th July, 2023 to the Deputy Director, DDA conveying Respondent No's.1 approval for allotment of Flat No.36 of Karuna Vihar, CGHS Ltd. in favour of the Petitioner. "To, The Deputy Director (GH), Delhi Development Authority, I.N.A., Vikas Sadan, New Delhi-110023.

Sub: Regarding confirmation the draw/allotment in the name of Sh Suresh Chand Jain (M.No 36) in respect of Flat No 36 in Karuna Vihar CGHS Ltd.

Sir, In supersession of this office letter No F.No.000220525/47/1270/GH/2022/710 dated 22.07.2022 on the subject cited above, I am directed to convey the approval of the Competent Authority for allotment of only one vacant flat i.e. Flat No 36 of Karuna Vihar CGHS Ltd in respect of Sh Suresh Chand Jain (M.No 36) s/o Late Sh.Mam Chand Jain members of Karuna Vihar CGHS Ltd (Regd.No. 1270/GH), Plot No 9, Sector 18A, Dwarka, New Delhi 110078. The said member has been verified on the basis of affidavits and other documents filed by the society. However, the contents of the affidavits have not been verified by this office.

Therefore, it is requested to take necessary action in respect of above said member.

Since DDA is not a party to the present writ petition, no direction can be issued to DDA.

Consequently, taking the aforesaid letter on record, the present writ petition is disposed of as satisfied.
