O R D E R

% 11.12.2019 Vide order dated 19.07.2019 passed in the present petition, it is recorded that settlement has been arrived at between the petitioner and the complainant and as per the settlement, the petitioner has agreed to pay a total sum of Rs.3,40,000/- to the prosecutrix. A sum of Rs.1,40,000/- has already been paid and Rs.2,00,000/- has to be paid at the time of recording of the statement in the quashing petition.

It is pertinent to mention here that the prosecutrix was present in Court on the said date and she did not dispute the submission recorded above and submits that she had no objection if the application is allowed and the petitioner is enlarged on bail. Accordingly, vide order dated 19.07.2019, subject to petitioner's joining investigation, no coercive action directed be taken against the petitioner till the next date of hearing. Thereafter, the same concession was granted to the petitioner and till

date the interim order is enforced.

Accordingly, the application is disposed of by directing the Investigating Officer that in the event of arrest, he shall be released on bail on his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to its satisfaction. The petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required.

In case of default of aforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law. The application is allowed and disposed of.
