The present application under Section 439 Cr.P.C has been filed by the Petitioner for grant of bail in FIR No.46/2024 dated 19.01.2024, registered at Police Station Mahendra Park for offences punishable under Sections 392/397/34 IPC.

The case against the Petitioner is that the Petitioner along one person are involved in taking Rs.5,000/- from a truck driver at knife point. It is stated that the chargesheet has been filed and the matter is listed before the Trial Court on 13.09.2024 for framing of charges. 3.

Learned Counsel appearing for the Petitioner seeks permission to withdraw the present application with liberty to approach this Court in case of change in circumstances.

Permission and liberty, as sought for, are granted. 5.

The bail application is disposed of as withdrawn, along with pending application(s), if any. It is made clear that this Court has not made any observations on the merits of the case.

However, in view of the fact that the Petitioner has been in custody for the last six months, the Trial Court is requested to hear the argument on charge on the date fixed and examine the only eye witness in this case as expeditiously as possible, preferably within a period of six months from today.
