O R D E R

The present petition has been filed seeking anticipatory bail in connection with FIR No. 266/2023 under Sections 25/54/59 of Arms Act registered at PS Crime Branch, South-West, Delhi. 2.
The case of the prosecution is that on a secret information, one accused namely Mukesh was arrested with one illegal weapon and two live rounds. During interrogation, the accused disclosed that he received the weapon from one Vinod @ Vikky Sanyasi. After arrest, Vinod disclosed that during his jail term, he had met one Jyoti Prakash @ Jyoti Baba (Kingpin of Nandu Gang) and he joined the said gang. Upon getting released on parole, Vinod received weapons from the present petitioner, as organized by Jyoti Baba. Premised on the above, the FIR in question came to be registered.

weapon in the present case is from the co-accused Mukesh and not from the present petitioner.

He further submits that as per the prosecution version, co-accused Mukesh had obtained the said weapon from one Vinod @ Vikky Sanyasi, as well as, co-accused Jyoti Prakash@ Jyoti Baba. The said co-accused have already been discharged.

He submits that insofar as co-accused Mukesh is concerned, he has already been granted bail.

Insofar as other cases stated to be registered against the present petitioner are concerned, the submissions of the learned counsel is that the petitioner is already on bail in the said cases. 8.
Considering the fact that the co-accused Vinod @ Vikky Sanyasi and co-accused Jyoti Prakash @ Jyoti Baba, who had allegedly procured the weapon from the present petitioner, have already been discharged and nothing was recovered from the present petitioner, and further regard being had to the fact co-accused from whom the weapon was recovered has been enlarged on bail, it is directed that in the event of petitioner's arrest, he be released on bail subject to his furnishing personal bond in the sum of Rs. 20,000/- and a surety bond of the like amount to the satisfaction of the Arresting Officer / SHO, further subject to the condition that he will join investigation as and when directed by the IO concerned. 9.
The petition stands disposed of.
