The Petition under Section 482 Cr.PC has been filed by the petitioner Rohit seeking quashing of the FIR bearing No. 453/2022 under Sections 376/328/313/506/509/34 IPC, registered at Police Station Badarpur. 2.

The complaint on 12.10.2022 gave a complaint against the petitioner and on the said complaint FIR No.453/2022 under Sections 376/328/313/506/509/34 IPC was registered by the Police at Police Station Badarpur.

It is submitted that the prosecutrix/respondent No.2 under some misunderstanding made a complaint of rape on the false promise of marriage.

However, now the parties have settled the matter and have entered into an MOU dated 16.04.2024, wherein the Prosecutrix has stated that because some misunderstanding she has got the FIR registered. both the parties have amicably sorted out all their differences with the intervention of their respective family members have left with no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

Learned Prosecutor has opposed this MOU on the ground that both the petitioner and respondent No. 2 were working together in a Laboratory and at that time they got into this physical relationship on the pretext of false marriage.

Considering the nature of allegations coupled with the compromise that the parties have entered into, it is not in the interest of either party to continue with the present petition.

In view of the settlement inter-se the parties and the nature of allegations made, the Petition is allowed. Accordingly, the FIR bearing No. 453/2022 registered at Police Station Badarpur, for offences punishable under Sections 376/328/313/506/509/34 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the petitioner.

The Petition stands disposed of.
