After arguing for sometime, learned counsel for the petitioner sought permission to withdraw the present writ petition with a liberty to file an appeal against the assessment order dated 25.03.2025. 2.

The liberty as prayed for is granted. Since the matter has remained pending before this Court and an interim order dated 04.08.2023 directing the Department not to enforce the recovery thereof was granted, we deem it appropriate to extend the period for filing the appeal. 3.

Hence, it is hereby ordered that in case the petitioner prefers an appeal by 15.04.2026, the appeal shall be taken into consideration on merit and no objection of limitation shall be raised therein.
