% 24.07.2019 CM. NO. 32117/2019 (for exemption) Exemption allowed subject to all just exceptions. Application stands disposed of.

W.P.(C) 7739/2019 The present petition has been filed by the petitioner with the following prayers:

"In these facts and circumstances, the petitioners most respectfully pray that this Hon'ble Court may be pleased to:-

a) pass appropriate writ, order or direction quashing/setting aside the notice dated 12.07.2019 and the letters emanating therefrom issued by the respondents under section 156 and 446 of Delhi Municipal Corporation Act, 1957 with respect to A-108, Southern Portion, Wazirpur Industrial Area, Delhi - 110052;

b) pass an appropriate writ, order or direction, directing the respondent Nos. 1 and 2 to allow the petitioner to inspect/ to provide copy of the Municipal records maintained with respect to the said property bearing No. A-108, Southern Portion, Wazirpur Industrial Area, Delhi - 110052 c) pass an appropriate writ, order or direction, directing the respondent Nos. 1 and 2 and to carry on their statutory duties by properly assessing the property tax of each unit independently and giving an updated assessment of their property tax after considering the tax already paid by the petitioner till date with respect to the property bearing No. A-108, Southern Portion, Wazirpur Industrial Area, Delhi - 110052;

d) pass such other or further orders including an order for costs of the present petition as this Hon'ble Court may deem fit, proper and expedient in the facts and circumstances of the present case."

Mr. Sanyam Khetarpal, learned counsel appearing for the petitioner states, petitioner is ready and willing to approach Municipal Taxation Tribunal provided the respondents give the relevant documents which they are in possession to enable the petitioner file an appeal. Ms. Mini Pushkarna, learned Standing Counsel appearing for respondent Nr. DMC on instructions state Nr. DMC has no difficulty in providing the concerned file to the petitioner for inspection.

Noting the said submission, petitioner is directed to appear before the authority on July 29, 2019 at 3 PM when the concerned file shall be given to the petitioner for inspection. Pursuant to the inspection, petitioner shall seek such remedy as available in law.

The petition stands disposed of.
