The present petition has been filed under Section 528 BNSS, 2023 seeking quashing of FIR No.103/2011 under Sections 420/467/468/471/448 IPC registered at Police Station Ranhola and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Petitioner nos.1 and 2, as well as, respondent no. 2, who are present in Court, have been identified by their respective counsel, as well as, by the Investigating Officer SI Rajat Khaiwal, PS. Ranhola and Insp. Anuj Nautiyal (I.O), PS. Special Cell.

The case of the prosecution is that the present FIR was registered at the instance of respondent no.2, who alleged that petitioner no.1 is trying to take unauthorised possession of her land and has also grabbed Plot No. B-5, Vikas Nagar Extn. New Delhi.

During pendency of the proceedings, the parties arrived at a settlement, the terms whereof were reduced in writing in the form of Settlement dated 10.03.2025 which is annexed as Annexure P-2 to the present petition.

It is a term of the settlement that respondent no.2 will cooperate with the petitioners for quashing of the present FIR. Respondent no.2, on a query posed by the Court, states that she has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between the parties. 8.
It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 9.
Consequently, the petition is allowed and FIR No.103/2011 under Sections 420/467/468/471/448 IPC registered at Police Station Ranhola alongwith all other proceedings emanating therefrom, is quashed. 10.
The petition stands disposed of in the above terms. 11.
