The present petition has been filed on behalf of the petitioner under Section 528 of BNSS (Section 482 Cr.P.C.) seeking quashing of FIR No. 601/2018 under Sections 356/379/34 IPC registered at PS-Rajouri Garden and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Petitioner as well as respondent no. 2 are present in Court. They have been identified by Mr. A.C.David, learned counsel for the petitioner, Ms. Vinky James, learned counsel for respondent no. 2, as well as, by the Investigating Officer IO/SI Mukesh Yadav, PS-Rajouri Garden. 6.

The case of the prosecution is that on 27.08.2018, while respondent no.2 was going towards his house after withdrawing money from the ATM, petitioner along with another boy came from behind and attacked him with a sharp object. The boy snatched his purse on petitioner's behest and they both fled from the spot, which led to the registration of present FIR. 7.

Mr. A.C. David, learned counsel for the petitioner submits that present case is a counter-blast of an FIR which was registered under Sections 498A/406/34 IPC at the instance of petitioner's sister, who was married to respondent no.2. It is contended that the said FIR has already been quashed. It is further submitted that the sister of the petitioner has also passed away.

During pendency of the proceedings the parties have arrived at a settlement, terms whereof were reduced in writing in the form of settlement dated 22.06.2022, copy of which is annexed as Annexure-P-4 to the present petition.

Respondent no.2, who is present in Court affirms the factum of settlement. On a query posed by the Court, he states that he does not wish to prosecute criminal proceedings any further and has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.

Consequently, the petition is allowed and the FIR No. 601/2018 under Sections 356/379/34 IPC registered at PS-Rajouri Garden alongwith all other proceedings emanating therefrom, is quashed. 13.

The petition stands disposed of in the above terms. 14.
