First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (old Provision 439 of the Code of Criminal Procedure) has been filed on behalf of the Petitioner, for grant of Regular Bail in FIR No. 453/2023 under Section 307/34 of the Indian Penal Code, 1860, registered at Police Station Seemapuri.

Learned counsel for the Petitioner seeks permission to withdraw the Bail Application with liberty to move an Application afresh after the Statement of the victim is recorded.

In view of the aforesaid, the Bail Application is permitted to be withdrawn with liberty as prayed for.

The learned Trial Court is also directed to make an endeavour to record the evidence of the public witnesses/victim expeditiously preferably within a period of six months.
