At the outset, learned Senior Counsel for the Petitioner submits that the Petitioner is seeking to limit his grievance to Prayer B in the present petition. Prayer B reads as follows:

"B. In the alternative, to direct the Respondent Corporation to give/extend the time of hearing by another four months, to enable the Petitioner to place on record the additional documents, to adjudicate matter in true latter and spirit of the directions passed by the Ld. Presiding Officer, ATMCD"

Learned Senior Counsel for the Petitioner further submits that there were certain documents necessary for adjudication that the Petitioner was unable to locate earlier, have recently been made available and hence, could not be placed before the quasi-judicial Authority (Deputy Commissioner, South Zone) where his Petition is pending adjudication. Learned Counsel for the Respondent, on instructions, submits that the Petitioner has already appeared before the quasi-judicial Authority on four/five occasions and has made submissions on those dates and that the hearing has already concluded before the quasi-judicial Authority and the Petitioner is only trying to delay the pronouncement. 4.

Learned Senior Counsel for the Petitioner disputes the contention and submits that the Petitioner only seeks an opportunity to conclude its submissions and place on record documents recently obtained and no further opportunities will be taken by the Petitioner thereafter, in proceedings before the quasi-judicial Authority.

As requested, the parties shall appear before the quasi-judicial Authority on 17.06.2024 at 3:00 p.m. The learned quasi-judicial Authority shall examine the documents sought to be relied upon and take an appropriate decision on their admissibility in accordance with law. 6.

The petition and all the pending applications stand disposed of with the aforesaid directions.
