Allowed, subject to all just exceptions.

W.P.(CRL) 1598/2024 2.

This petition has been filed under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.'), seeking the following relief:- "(i) Issue direction to the Special Court (SC/ST Act) presided over by Ms. Sheetal Chaudhary Pradhan, Ld. ASJ, South-East District, Saket Courts, New Delhi for disposal of the Application U/s-156(3) Cr.P.C. bearing C.C. No. 1/2024 titled as "Ramchandra Vs.

Dharmender Soni & others" as expeditiously as possible within stipulated period of two months in pursuant to the statutory provisions of the section 14 (3) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989 as amended by the Amendment Act, 2015;"

The learned counsel for the petitioner submits that the above complaint was filed on 23.02.2024, whereupon the learned Special Judge, (South-East), Saket Courts, New Delhi called for an Action Taken Report from the Investigating Officer concerned. He submits that, however, the matter is not being taken up expeditiously. 4.

The learned counsel for the respondent, who appears on advance notice, points out that on the last date of hearing before the learned Special Judge, that is, 09.05.2024, it was the counsel for the complainant who was not present, because of which the adjournment had to be granted.

Be that as it may, the learned Trial Court is requested to expeditiously consider the complaint filed by the petitioner along with the application filed under Section 156(3) of the Cr.P.C. and not granting any unwarranted adjournment to either party. 6.

The petition is disposed of.

It is made clear that this court has not considered the merits of the underlying complaint filed by the petitioner and pending consideration before the court of the learned Special Judge. 8.

Let a copy of this order be sent to the learned Special Judge for information and ensuring compliance.
