On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that the parties are real brothers and the dispute emanated out in regard to the property. It is submitted that on 26.03.1966, Late Sh. Radhakrishnan Nagpal acquired a residential plot bearing No.C-6/60, Safdarjung Development Area, New Delhi from DDA and on 17.02.1979, he was entered into an Agreement to Sell. On 27.02.1979, a General Power of Attorney was entered into by Radhakrishnan Nagpal in favour of the Petitioner. Thereafter, on 11.08.1989, Mr. L.N. Burman, father of the Complainants and Petitioner, passed away. It is further submitted that on 09.09.2010, Complainant No. 2 filed a Civil Suit bearing CS(OS) No. 1902/2010. On 17.07.2020, Notice under Section 91 Cr.PLC has been served by the Inspector/EOW to the Petitioner directing him to produce the name of Bank along with any proof of account in his name. It is further stated that on 08.09.2020, a letter has been written by the Petitioner to the Special Commissioner Economic Offences Wing stated that the Complaint and FIR made against him is motivated and mala fide and an arm twisting tactic. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.178/2019 under Section 406/418/420/467/468/471/474 read with Section 120-B of IPC, got registered at Police Station Economic Offences Wing. 8.

It is stated that the Petitioner and the Respondent Nos.3 and4 have amicably settled all the disputes and differences between them and arrived at Settlement Agreement dated 24.07.2025, before the Delhi High Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Mediation and Conciliation Centre, Delhi High Court, New Delhi. In the Settlement, it was inter alia settled between the parties that they shall withdraw all Complaints/FIRs filed with EOW or elsewhere. It is further settled that all the parties are siblings and a view to put quietus to the litigation and to promote peace and harmony in the family, have agreed voluntarily to put an end to all pending litigations, both Civil and Criminal. 9.

Today, the Respondent Nos. 3 and 4, who are present in the Court and identified by their respective counsel, state that they have no objection if the said FIR is quashed.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 178/2019 under Section 406/418/420/467/468/471/474 read with Section 120-B of IPC, registered at Police Station Economic Offences Wing and all the consequential proceedings emanating therefrom are quashed.

The Application is disposed of accordingly.

In view of the order passed today in the Application bearing CRL.M.A. 23093/2025, the present Petition is disposed of accordingly. 14.
