This suit is instituted on behalf of the Plaintiff seeking permanent injunction against infringement of trademark and copyright as well as passing off.

Plaintiff is one of the India's leading real estate development companies in the affordable and mid-segment housing category and has launched multiple residential/commercial projects under the brand SIGNATUREGLOBAL. As stated in the plaint, Plaintiff has built a strong presence in NCR including Gurugram, Sohna as also Delhi and is registered in RERA. Plaintiff has a strong and distinctive digital footprint through its official website www.signatureglobal.in and extensively uses the social media platform to advertise, engage consumers, launch projects and redress the grievances.

Plaintiff is the registered proprietor of several trademarks comprising the mark SIGNATUREGLOBAL and distinctive device mark . Details of registration are given in paragraph 20 of the plaint and the earliest registration dates back to 2014. Details of increasing revenues earned by the Plaintiff between April, 2020 and December, 2024 are also furnished in the plaint.

The cause of filing the present suit was a show cause notice dated 19.02.2025 received by the Plaintiff from HRERA alleging that Plaintiff was advertising and circulating on online portals and social platforms sale of plots under the Deen Dayal Jan Aawas Yojana in Gurugram without valid registration from HRERA. Plaintiff discovered various websites/URLs that were imitating Plaintiff's registered trademarks as also corporate name to cheat unvary customers and a police complaint was filed. Plaintiff also informed HRERA that the website mentioned in the show cause notice had no association with the Plaintiff. On discovery of further infringing websites, another police complaint was filed and thereafter, the present suit was instituted.

By order dated 15.05.2025, Court granted ex parte ad interim injunction directing Defendants No.1 to 9 and all others acting on their behalf to takedown/block/remove/suspend/delete the impugned websites/URLs as mentioned in the order, which incorporated Plaintiff's registered marks SIGNATUREGLOBAL/ . They were also restrained from registering/operating/owning/hosting/publishing any websites/domains/URLs that incorporated the said registered marks. Direction was issued to Defendants No. 10, 11, 12 and 13 (DNRs) to lock and suspend the websites and Defendant No.11 was also directed to provide all available details of registrations including payment details in respect of domains mentioned in the order at serial nos. 1, 3, 4, 6, 7, 8, 9 and 11. 6.

As the order sheets indicate, Defendants No. 4, 9 and 10 have been deleted. Defendant No. 1 is a John Doe. Defendants No. 2, 3, 5, 6, 7, 8 and 12 have been served but have chosen not to appear and contest the suit and are proceeded ex parte.

In light of the fact that Defendants No.1 to 8, save and except, Defendant No.4 have chosen not to contest the suit, the temporary injunction is made absolute and the suit is decreed in terms of sub-clauses (A), (B), (C), (D) and (E) of the prayer clause of the plaint. Learned counsel for the Plaintiff, on instructions, gives up other reliefs. 8.

Registry is directed to draw up the decree sheet. 9.

Counsel for Defendant No. 11, on instructions, submits that said Defendant is agreeable to transfer domain names at serial nos. 1, 3, 4, 6, 7, 8, 9 and 11 mentioned in paragraph 3 of the plaint. The statement is taken on record, directing Defendant No.11 to transfer the domain names in favour of the Plaintiff, subject to payment of registration charges, if any. Defendant No. 13 is directed to transfer domain name at serial no. 12 mentioned in paragraph 3 of the plaint in favour of the Plaintiff, subject to payment of registration charges, if any.
