The petitioner has filed this petition under Article 226 of the Constitution, assailing the disciplinary order dated 31.05.2023 passed against him.

The petitioner has approached this Court against the same disciplinary order in W.P.(C) No. 8949/2024, which was disposed of by order dated 04.07.2024, by permitting him to withdraw the petition, with liberty to file an appeal under Rule 69 of the State Bank of India Officer's Service Rules, 1992 ["the Rules"].

In the present writ petition, however, the petitioner's case is that he filed an appeal on 09.07.2024, but the appeal has not been disposed of. He has only annexed to the writ petition an order of the Appellate Authority dated 14.08.2024, by which delay in filing of the appeal was condoned.

of India, who appears on advance instructions, however, submits that the Appellate Committee has disposed of the petitioner's appeal by order dated 24.09.2024, which, according to the respondent-Bank, was communicated to the petitioner under cover of a letter dated 05.10.2024. Copies of the order and the said communication have been handed up in Court, and are taken on record.

Mr. Kapur further submits that the petitioner has a remedy of review against the said order under the Rules. 6.

Mr. R.S. Gautam, learned counsel for the petitioner, submits that this order was never received by the petitioner. However, he submits that if the order is served upon the petitioner, the petitioner will invoke the remedy of review.

Having regard to these submissions, the writ petition is disposed of, with the direction that a copy of the order dated 24.09.2024 and communication dated 05.10.2024 be supplied by Mr. Kapur to Mr. Gautam, by tomorrow, i.e. 16.05.2025. The petitioner will be at liberty to seek review against the order dated 24.09.2024, and if the review application is filed within a period of thirty days from today, the review may be considered in accordance with the applicable parameters, regardless of the delay in filing of the review. 8.

The writ petition is disposed of in these terms.
