After some arguments, the learned counsel for the respondent agrees that the impugned order be set aside and the parties be referred to Arbitration leaving it open for the parties to seek appropriate reliefs before the Arbitral Tribunal.

Although the scope of the present appeal does not entail appointment of an arbitrator; however to obviate any further delay and at the request of the learned counsel for the parties, we direct that the arbitrator be appointed by the Delhi International Arbitration Centre [DIAC]. The Arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules. 3.

approaching the Arbitral Tribunal for any interim measures or protection, including the relief granted by the learned Commercial Court in terms of the impugned order. Needless to state that if any such application is moved, the same would be considered in accordance with law, uninfluenced by the impugned order.

The appeal is disposed of in the aforesaid terms. The pending application is also disposed of.
