% 30.01.2017 Crl. M.A. No. 1676/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.
CRL.M.C. 375/2017 Issue notice. Notice is accepted on behalf of the State. The petitioner has preferred this petition to seek the quashing of FIR No.576/2014 under Section 323/354/ 376 and section 4/6/10 of POCSO Act registered at PS Anand Parbat and the proceedings arising therefrom. The petition is premised on the statement of the prosecutrix which shows that she has turned hostile.
Merely because the prosecutrix may have turned hostile is no reason for this court to step in and quash the FIR and the proceedings arising therefrom at this stage. The trial is pending and it shall be for the trial court to appreciate the entire evidence on record.
Counsel for the petitioner, therefore, seeks leave to withdraw this petition with the prayer that the trial may be expedited. The petition is, accordingly, dismissed as withdrawn. The Trial Court shall expedite the trial in the case. It is hoped that after recording of remaining evidence, the case shall be disposed of within the next one year. No unnecessary adjournment shall be sought for and granted to the parties. VIPIN SANGHI, J JANUARY 30, 2017 sr
