This is an application filed on behalf of the Applicant Monish S/o Late Sh. Mohd. Zahid under Section 438 Cr.P.C. seeking anticipatory bail in case FIR No.174/2023 dated 17.05.2023 under Sections 307/34 IPC read with Sections 25/27/54/59 of the Arms Act, 1959 registered at PS: Chandni Mahal.

By order dated 07.08.2023, this Court had granted interim protection to the Applicant against any coercive action till next date of hearing, subject to the Applicant joining investigation, as and when directed by the Investigating Officer and fully co-operating in the same. Interim protection has continued till date.

Status report has been filed on behalf of the State along with the SCRB. Learned APP, on instructions from the IO, who is present in Court, states that investigation is complete and charge sheet has been filed. Applicant has been joining investigation and co-operating in the same and custodial interrogation is not required. It is further submitted that the matter is at the stage of prosecution evidence before the Trial Court. 4.
In view of the aforesaid submissions made on behalf of the State, the application is allowed and it is directed that in the event of arrest, Applicant shall be released on bail, subject to furnishing a personal bond in the sum of Rs.25,000/- with two sureties of the like amount each, to the satisfaction of the concerned Trial Court and further subject to the following conditions:- i.
Applicant shall not leave the country without prior permission of the Trial Court;
ii.
He shall furnish his mobile number to the IO and keep the same active at all times and shall not change the mobile number without prior intimation to the IO and the Trial Court; iii.
He shall appear before the Trial Court on the dates of hearing; iv.
He shall not, directly or indirectly, indulge in any illegal activity or make any inducement, threat or promise to any person associated with the case including the Complainant; and v.
He shall furnish his current residential address to the IO and intimate any change in the same to the IO and the Trial Court by way of an affidavit.

Application stands disposed of in the aforesaid terms, making it clear that this Court has not expressed any opinion on the merits of the case. Pending application also stands disposed of.
