This is an application filed by the respondent nos. 1 and 4 seeking condonation of delay 29 days in filing the counter affidavit. 2.

For the reasons stated in the application, the delay in filing counter affidavit is condoned and the counter affidavit filed by respondent nos. 1 and 4 is taken on record.

The application is disposed of accordingly.

FAO 164/2023 FAO 195/2023 1.

At the outset, learned counsel appearing for the respondents states that though appellant-Narendra Kumar Dikshit has preferred the appeal being FAO No.195/2023, he is also the appellant no.2 in FAO No.164/2023. It is further stated that the impugned order in both the appeals is the same. 2.

Appellant-Narendra Kumar Dikshit is present in person in the Court along with Mr. Amarjeet Singh, Advocate, who has shown his signatures on the appeal paper book of FAO No.164/2023, which he admits to have signed.

In view of the above, appellant-Narendra Kumar Dikshit seeks leave to withdraw FAO No.195/2023. It is ordered accordingly and the FAO No.195/2023 is dismissed as withdrawn.

None is present on behalf of the appellants in FAO 164/2023. 5.
