The matter was today listed for preliminary hearing of CM No. 11293/2024 and CM No. 11200/2024. However, after part arguments, learned counsel for both sides arrived at settlement on instructions of their respective clients, present in court. By way of CM No. 11293/2024, the present petitioner/tenant sought extension of time to pay the use and occupation charges, while by CM No.11200/2024, the respondent/landlord sought dismissal of the present revision petition on grounds of non payment of the use and occupation charges. According to the respondent, there are arrears of about Rs.80,000/- towards rent/use and occupation charges but she agrees not to claim the same if the petitioner vacates the subject premises by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 31.03.2024, for which the petitioner is agreeable. Learned counsel for both sides have explained in vernacular these terms to their respective clients present in court.

Accordingly, it is brought on record that on or before 31.03.2024, the petitioner shall hand over vacant possession of the subject premises to the respondent and in return, the respondent shall not claim any money towards use and occupation charges or rent pertaining to the subject premises. 3.

Learned counsel for petitioner on instructions of his client, seeks permission to withdraw this petition with above protection. 4.

Under these circumstances, the petition is dismissed as withdrawn on compromise with the directions that operation of the impugned eviction order shall remain stayed till 31.03.2024 and the present respondent shall not claim any use and occupation charges or rent pertaining to the subject premises; and that in case by 31.03.2024 the subject premises are not vacated by the petitioner, the execution proceedings shall continue further and the respondent shall be entitled to claim complete arrears of use and occupation charges; and that subject to the petitioner vacating the subject premises, the parties shall on or before 30.04.2024 withdraw all other litigations pertaining to the subject premises filed by them against each other.
