% 09.03.2016 The proposal given by Mr Lall on 25.02.2015 is not acceptable to the respondents. As such, the appellant is not bound by that offer. Mr Lall, the learned counsel for the appellant, seeks permission to withdraw this appeal with liberty to pursue his application under Order 39 Rule 4 CPC before the learned Single Judge. That application (IA No. 22645/2015) and the application under Order 39 Rules 1 and 2 CPC (IA14098/2015) filed on behalf of the respondents shall be considered by the learned Single Judge on merits. We are making it clear that we have not expressed any opinion on the merits of the matter.
