Applicant Mala Verma, who is facing trial for committing offences under Sections 363/368/370/34 IPC, seeks regular bail. She was arrested on 05.05.2024 and is in continuous incarceration since then. 2.

Charges have already been ascertained and prosecution evidence is being led.

As per case of prosecution, applicant, while accompanied by her daughter, had stolen a seven months child. She and her such daughter were eventually arrested. Fortunately, the stolen child has been recovered and restored to the family.

Fact, however, remains that daughter of the applicant, who is also facing identical allegations, has already been released on bail. 5.

Admittedly, mother of the victim child has already been examined. 6.

examination-in-chief, she did not even identify the applicant and it was only when the prosecution had sought permission to cross-examine her, she was able to point-out towards her. He also submits that in her cross-examination also, she has come up with answers which rather indicate that she was not even present at the time of the alleged commission of offence. 7.

Nominal roll of the applicant is on record which shows no other involvement of any kind.

Keeping in mind the overall facts and circumstances of the case and her previous clean antecedents and the fact that material public has already been examined albeit without expressing any opinion over the merits of the case, applicant is directed to be released on bail on her furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of concerned learned Trial Court/Chief Judicial Magistrate/Judicial Magistrate First Class.
