After hearing arguments for some time, learned counsel for the petitioner, without prejudice to his rights and contentions, does not press the present petition.

Learned counsel for the petitioner, however, submits that when he had moved an application under Order XXXII Rule 15 CPC, he had, clearly, mentioned that the respondents in the probate petition i.e. Smt. Raj Mehta and Smt. Santosh Mehta were octogenarians and that they both are not able, mentally as well as physically, to secure their interest in the subject property.

Fact remains, both of them are already duly represented by a counsel before the learned Probate Court and the learned Probate Court can always, wherever it deems proper and expedient in the interest of justice, can cross-check whether they have been able to instruct their counsel properly and whether the probate petition is being pursued as per their instructions or not.

It is expected that before finally disposing of the matter, the learned Trial Court would, certainly, look into the abovesaid aspect. 5.

The petition is, accordingly, disposed of as not pressed. 6.

Pending applications, if any, also stand disposed of. 7.

Copy of the order be given dasti to both the parties under the signatures of Court Master.
