The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 439 of the Code of Criminal Procedure, 1973) seeking regular bail in proceedings arising from FIR No. 758 /2023 dated 16th October, 2023 registered under Sections 394/397/365/34 of IPC at P.S. Seemapuri.

The Court is informed that the statement of the victim is yet to be recorded.

In light of the above, after making some submissions, counsel for the Petitioner states that he would like to withdraw the present petition and seeks liberty to reapply after the statement of the victim is recorded. 4.

The present petition is dismissed as withdrawn with liberty as prayed for.
