O R D E R

% 28.03.2017 1.

The appellant has paid a sum of Rs.1,93,000/- to the respondent in full and final settlement of his claims under the award dated 28th October, 2016. 2.

The respondent present in person gives up his claim of interest and penalty and accepts Rs.1,93,000/- from the appellant in full and final settlement.

The respondent present in person submits that he has claim of gratuity against the appellant which is disputed by the appellant. The respondent is at liberty to avail appropriate legal remedies available to him accordance with law for his claim of gratuity.

The settlement between the parties is taken on record. This appeal is disposed of in terms of the full and final settlement of the claim relating to the Employees Compensation between the parties. 5.

The record of the Commissioner, Employees' Compensation be returned back forthwith.

6.

In view of the settlement between the parties, the Commissioner, Employees' Compensation shall close the case relating to the penalty proceedings.

7.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
