% 02.02.2018 Petitioners are seeking quashing of FIR No.0404/2016 registered under Sections 498A/406/34 of the IPC at police station Jagat Puri on the complaint of respondent no.2. Respondent no.2 is present. Her presence has been identified by the investigating officer present in Court. Petitioner no.1 and respondent no.2 had got married according to Hindu rites on 28.4.2015. They have been living separately since 04.6.2015. They have been divorced by a mutual consent by a decree dated 07.12.2017. Petitioner no.1 and respondent no.2 admit that no child has born from the wedlock. In view of the settlement arrived at between the parties, Rs.1.5 lakhs have been paid by petitioner no.1 to respondent no.2. The entire amount stands paid. This submission as noted supra has been
endorsed by the parties. This is a fit case where the prayer made in the petition should be allowed.
Accordingly, FIR No.0404/2016 registered under Sections 498A/406/34 of the IPC at police station Jagat Puri on the complaint of respondent no.2 and all the proceedings emanating therefrom stand quashed.
Petition disposed of in the above terms.
