Perusal of the various order sheets shows that the last appearance on behalf of the petitioner was on 08th February, 2023. 2.

The order dated 10th January, 2024 passed by the Joint Registrar (Judicial) shows that the respective counsels, i.e., counsels for the petitioner and respondent no.2, have been served on 16th and 17th November, 2023. Further, it is recorded that the registered trademark agent of the petitioner was also served on 08th November, 2023.

This Court also notes that in the order dated 10th January, 2024, it is recorded that the owner of the petitioner firm had expired. Accordingly, learned counsel for the petitioner had stated that he would be taking steps to implead the legal heirs of petitioner.
