The Joint Registrar through order dated 07th February, 2024, has given a status of the service of the parties to the following effect: "In furtherance of the order dated 30.11.2023, it has been reported by the registry that no details/addresses of the registered trademark agent of the respondent are available on record. The same order also shows that the court notice of the respondent remained unserved since "no such firm existed" at the given address. Its counsel was also served on 26.09.2023, but none appeared and thus the service of the registered trademark agent of the respondent was ordered. However in view of the aforesaid report of the registry, the registered trademark agent can neither be served, nor his details could be unearthed.

Further more, the record shows that even the petitioner is not appearing or participating, though its counsel had last appeared on 28.04.2023.

The record however suggests that the pleadings were already completed before the Intellectual Property Appellate Board. In the given circumstances, List the matter before the Hon'ble Court on 22.03.2024."
