An Application under Section 378(3) read with Section 482 of Cr.P.C has been filed on behalf of the Petitioner seeking Leave to Appeal against the impugned Judgment dated 10.01.2020 passed by learned ASJ-06, West District, Tis Hazari, Delhi in case FIR No.387/2014 under Section 323 IPC and Section 8/10 POCSO Act registered at Police Station Nangloi. 2.

The grounds of challenge are that the learned Trial Court has failed to appreciate the testimony of the victim who was consistent in her statement in the Court as well as under Section 164 Cr.P.C and only turned hostile during her cross-examination. The prosecution was able to bring home the guilt of the accused through the testimony of Prosecutrix in corroboration of the medical documents and the statements under Section 164 Cr.P.C. Therefore, a prayer is made that the Application may be allowed. 3.

Considering the submissions made, the present Application for grant of Leave to Appeal is allowed and stands disposed of accordingly. Vide Order dated 27.10.2025 it was directed that the written submissions be filed within fifteen days, but the same has not been filed till date.
