This petition has been filed by the petitioner challenging the Order dated 07.09.2021 passed by the respondents, transferring the petitioner from 103 RAF, Wazirabad, Delhi to 183 Btn., J&K with immediate effect.

As the petitioner was not granted any interim relief in the present petition, the petitioner joined the duty at 183 Btn., J&K in accordance with the impugned order, and more than three years have passed since.

nothing further survives for adjudication in the present petition. 4.

The learned counsel for the petitioner, however, draws our attention to the Standing Order No. 07/2015 dated 04.08.2015, being the transfer policy concerning the transfer of Non-Gazetted (Executive/Technical/Tradesman) Force Personnel including Mahila Personnel, to submit that the posting of a male officer at a particular place would be for a period of three years. He submits that as the petitioner has already served with the 183 Btn., J&K for more than three years, his case for transfer back to Delhi be considered by the competent authority.

We allow the petitioner to make such representation to the competent authority and we expect that the competent authority to consider the same in accordance with law within a period of eight weeks of receipt of such representation.

We, however, make it clear that we have not expressed any opinion on the merits of the above recorded submission of the learned counsel for the petitioner.
