The Matter has been placed before us in the National Lok Adalat with the consent of the parties. The appellant is present along with his counsel. The respondent is represented by its counsel. 2.
The parties have settled the matter along with civil liability of case amounting on the appellant/Sanjay. Though the appellant/Sanjay has been convicted vide judgment dated 04.12.2012 passed by the learned Additional Sessions Judge, Special Court under the Electricity Act, 2005 whereby he was directed to pay Rs.4,01,186/- as fine including sum of Rs.2,68,124/- towards the civil liability, the BSES/respondent herein is willing to settle the entire matter upon payment of balance sum of Rs.1,07,250/- by the appellant/Sanjay towards full and final settlement of the outstanding amount of Rs.2,68,124/-.

It is informed that the appellant has already deposited Rs.1,34,062/- with the Registrar General of this Court. The appellant has assured the Lok Adalat that the balance sum of Rs. 1,07,250/- will be deposited with the BSES as per the following schedule :- Rs. 35,000 on or before 15st July, 2019 Rs. 35,000 on or before 31st July, 2019 Rs. 37,250 on or before 30th August, 2019.

Learned counsel for the respondent submits that in case the appellant pays the above mentioned sum in terms of the settlement, then, the respondent shall not press for criminal prosecution. 5.
The appellant shall pay the instalments by way of demand drafts/ bank drafts.

Settlement is recorded in the above terms.

This Award be placed on the record of the case. 8.
The file be consigned.
