This writ petition is filed for quashing of charge sheet dated 31.07.2020 issued by the respondents.

During the pendency of this petition vide order dated 27.05.2025, the interim order was modified and the petitioner was directed to submit reply to the charge sheet dated 31.07.2020 within a period of four weeks. 3.
Learned counsel for the petitioner submits that the order has been complied with and the reply was filed. It is submitted that there is an issue as to whether a charge sheet can be issued to a retired employee. 4.
Learned counsel for the respondents submits that as per the statutory provisions, the charge sheet can be issued after retirement provided the cause of action arose prior to retirement.

The petitioner shall have an effective opportunity to raise the issue raised in this petition before the Inquiry Officer as well as the disciplinary authority at an appropriate stage.

The writ petition is disposed of with liberty to the petitioner to raise this plea before the Inquiry Officer and the Disciplinary Authority if need so arises. There is no doubt that in the eventuality of the plea being raised, the same shall be dealt in accordance with law. The petitioner if so advised within four weeks from today, may file an additional response to the charge sheet.

Needless to say that the petitioner shall be at liberty to avail remedies in accordance with law for redressal of the surviving grievance, if any.
