This reference was registered in view of the reference made by the then Presiding Officer, Motor Accidents Claim Tribunal-01, Central, Tis Hazari Courts, Delhi.

The questions that were referred have been recorded by us in our order dated 18.11.2022.

Thereafter, vide order dated 23.08.2023, the hearing of the present reference was adjourned sine die in view of the pendency of a writ petition, being W.P.(C) 795/2019, titled as Ruma Purkait vs. Union of India & Ors., before the Supreme Court, which raises some The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. of the similar issues.

In fact, we are informed that another set of writ petitions, being W.P.(C) 12067/2018, titled as Amit Sahni vs. Union of India and Ors. and W.P.(C) 7794/2018, titled as Amit Sahni vs. Union of India through Ministry of Home Affairs, were also listed before this Court raising almost similar issues, and were disposed of by a Division Bench of this Court vide order dated 13.04.2023 in view of the pendency of the above writ petition before the Supreme Court. 5.
Keeping in view the above, we dispose of this reference awaiting the outcome of the abovementioned writ petition before the Supreme Court.

However, we direct the Registry of this Court to place this reference again before us once the decision in the above referred writ petition pending before the Supreme Court is pronounced.
